Right of Withdrawal and Warranties

1. Right of Withdrawal (14 days)
Pursuant to Articles 52 et seq. of the Consumer Code (Legislative Decree No. 206 of September 6, 2005, as amended), a customer who qualifies as a consumer (a natural person purchasing for purposes unrelated to their professional activity) has the right to withdraw from the contract, without having to provide any reason, within 14 days of physically receiving the item (or the last item, in the case of an order with multiple items shipped separately).
1.1 How to Exercise the Right of Withdrawal
The customer may exercise the right of withdrawal by sending, within the 14-day period, an explicit notice to info@guerrastore.it, using, if desired, the standard withdrawal form provided in Annex I, Part B, of the Consumer Code, or by any other explicit statement of their intention to withdraw.
1.2 Return of the Goods
The customer is required to return the goods within 14 days of the date on which they notified the company of their withdrawal, in good condition and, as far as possible, in the original packaging, with the labels still attached. Return shipping costs are the responsibility of the customer, unless otherwise explicitly stated at the time of purchase.
1.3 Refund
Guerra S.r.l. will refund all payments received from the customer, including the initial shipping costs (excluding any additional costs resulting from the customer’s choice of a delivery method other than the least expensive standard option offered), without undue delay and in any case within 14 days from the day Guerra S.r.l. is notified of the decision to withdraw. Guerra S.r.l. may withhold the refund until it has received the goods back, or until the customer provides proof of return, whichever comes first. The refund will be issued using the same payment method the customer used for the initial transaction, unless otherwise explicitly agreed.
2. Exceptions to the Right of Withdrawal
Pursuant to Article 59 of the Consumer Code, the right of withdrawal does not apply, among other cases, to:
- goods that are made-to-measure or clearly personalized;
- goods that are liable to deteriorate or spoil rapidly;
- sealed goods that cannot be returned for hygiene reasons or for reasons related to health protection, if opened after delivery.

3. Legal Warranty of Conformity (24 months)
All products sold are covered by the legal warranty of conformity provided for in Articles 128–135 of the Consumer Code, valid for 24 months from the delivery of the goods, for defects of conformity existing at the time of delivery and that become apparent within that period.
3.1 Reporting the Defect
The customer forfeits the benefits of the warranty if they do not report the lack of conformity to Guerra S.r.l. within 2 months of discovering the defect, unless Guerra S.r.l. has concealed the defect.
3.2 Remedies
In the event of a confirmed lack of conformity, the customer is entitled, at their discretion and in accordance with the conditions set forth in Articles 130 et seq. of the Consumer Code, to:
- free repair or replacement of the goods, unless the requested remedy is impossible or excessively burdensome compared to the other;
- alternatively (if repair or replacement is not possible, has not been carried out within a reasonable time, or has caused significant inconvenience): a price reduction or termination of the contract with return of the goods and a refund of the price paid.
